Terms & Conditions for NameZap

1. Eligibility

You must be at least 13 years of age to use NameZap. By using the App, you represent and warrant that you meet this age requirement.

2. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content

You may submit names, notes, photos, and other content ("User Content") to the App. You retain ownership of your User Content but grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, modify, and display it in connection with providing our services.

You agree not to submit content that:

• Is unlawful, harmful, or offensive
• Infringes on any third-party rights
• Contains personal information of others without consent

4. Subscription and Payment

NameZap offers both free and paid (Premium) accounts. Premium access is charged at $2.99 per year and unlocks enhanced features.

4.1 Free Users

• First 10 name adds include premium features
• Limited to 100 total name adds
• Cannot manage tags
• Flash Mode limited to 10 uses per month

4.2 Premium Users

• Unlimited name adds
• Access to full features including photos, location, date, social links, and extended notes

All payments are processed through secure third-party providers. Subscription fees are non-refundable except where required by law.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful or prohibited purpose
• Interfere with or disrupt the integrity of the App
• Attempt to access data or systems without authorisation

6. Intellectual Property

The NameZap app and all related content (excluding User Content) are the property of SandenHub or its licensors. You may not reproduce, distribute, or create derivative works without permission.

7. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that harms the App or its users. You may delete your account at any time through the app settings or by contacting support.

8. Disclaimers

The App is provided on an "as-is" basis. We do not guarantee that it will be error-free, secure, or continuously available. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of Liability

To the extent permitted under applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount paid by you, if any, in the 12 months preceding the claim.

10. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the App or email. Continued use after changes indicates your acceptance.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of that jurisdiction.
